Our general conditions of sale

These conditions of sale are concluded:

- on the one hand by the company Petit Pan SARL with capital of 10,000 euros, domiciled at 7, rue de Prague – 75 012 Paris FRANCE, registered in the Paris trade and companies register under number 480 128 156 below called “Little Pan”

- and on the other hand, by any natural or legal person wishing to make a purchase via the Petit Pan website, hereinafter referred to as "the buyer".

Object :

These conditions of sale aim to define the contractual relations between Petit Pan and the buyer and the conditions applicable to any purchase made through the Petit Pan merchant site.

It is specified that the products and services are reserved for individuals and intended for the personal use of the buyer, unrelated to their professional use.

The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these conditions of sale.

These conditions of sale will prevail over any other general or specific conditions not expressly approved by Petit Pan.

Petit Pan reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Characteristics of the goods and services offered

The products and services offered are those which appear in the catalog published on the Petit Pan website.

These products and services are offered while stocks last.

The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to the colors.

Prices

The prices appearing in the catalog are prices including tax in euros taking into account the VAT applicable on the day of the order in the territory of mainland France; any change in the rate may be reflected in the price of the products or services.

Petit Pan reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.

The fixed amount of participation in the preparation and delivery costs will be communicated to the customer on the order summary form, before validation of the latter.

Orders

The procedure for placing an order on the site is subject to compliance with the different steps that the customer must follow to validate their order.

The customer selects the item(s), where applicable the size and quantity that they wish to purchase on the site by clicking on the “ Add to cart ” box.

When the customer wishes to validate their order, they must click on the “ Order ” box accessible in the “ Basket ” tab.

The customer must then identify themselves. When registering, they must complete the form provided for this purpose under the “ Registration ” tab (in particular last name, first name, email address, postal address, telephone number), this information being mandatory for processing and delivery orders and preparation of invoices. The customer must read the confidentiality and processing of personal data policy and check the box provided for this purpose. If the customer is already registered, he will fill in his username and password to identify himself.

The customer pays by choosing the payment method and filling in the necessary fields.

After checking the summary status of the order and clicking on the " Pay my order " button, the customer acknowledges having read and accepted all of Petit Pan's general conditions of sale.

The order is then registered and cannot be modified, without prejudice to the application of the article of these General Terms and Conditions relating to the right of withdrawal. Upon receipt of payment for the order, Petit Pan sends a confirmation email summarizing the order (Items, price, quantity, etc.).

Returns

The customer has a right of withdrawal for a period of 15 (fifteen) days from receipt of his order.

We accept all returns with the exception of our cut fabrics (printed cotton and coated cotton) and our products discounted during all promotional periods and commercial operations except in the case of size exchange.

The customer must demonstrate to Petit Pan their desire to withdraw by requesting a return to the following address: hello@petitpan.com , in order to receive a prepaid return label.

The customer must then return the items to Petit Pan within 14 (fourteen) days following communication of their decision to withdraw. The item(s) must be returned in their original packaging, in their original condition, new, unworn, unused. washed.

The customer having delivered OUTSIDE Metropolitan France bears the entire return costs.

To make a return, the customer must follow the procedure indicated in the “ Frequently asked questions / Return and refund ” section.

We inform you that the returned item(s) will be reimbursed by Petit Pan using the same means of payment as that used to pay for the order at the latest within 15 days following the date on which Petit Pan will have taken note of the customer's decision to withdraw.

Petit Pan may defer reimbursement until the items have been recovered or until the customer has provided proof of shipment of these items, the date chosen being that of the first of these events. Petit Pan is not required to reimburse additional costs resulting from a more expensive delivery method than the standard delivery method. Return costs are the responsibility of Petit Pan if the item delivered is different from the item ordered or damaged. If the customer fails to comply with these General Terms and Conditions, in particular the return conditions, Petit Pan will not be able to reimburse the items concerned.

For returns from countries outside the European Union:

The customs declaration attached to the package must mention that it is a customer return as well as the reason for the return. We advise you to use the carrier who ensured your first delivery and to ensure that no charges are applicable upon receipt of the package. In the event of charges upon receipt of the package, the package will be systematically refused.

Payment terms

The price is due when ordering.

Payments will be made by credit card; they will be carried out through the secure system of Société Générale which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can become aware of it during transport on the network.

The buyer's account will be debited upon validation of the order for the amount of the products or services sent.

The buyer will be sent a paper invoice showing VAT.

Deliveries

Any product purchased on the site is only deliverable within the offer area. The product is delivered to the delivery address provided by the customer when placing the order.

The delivery time of a product, as indicated on the site when accepting the order, is a usual average time and corresponds to the time for preparing the order, to which is added the time and delivery by the carrier, and does not take into account possible customs clearance delays. This deadline assumes that the order has been placed from Monday to Friday before 10:00 a.m. Paris time, excluding public holidays or non-working days.

Petit Pan cannot be held responsible for delivery delays which are attributable either to the customer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.

Guarantees

The user benefits from the guarantee of hidden defects and conformity in accordance with the provisions of articles 1641 to 1649 of the civil code and articles L.217-4 to L.217-14 of the Consumer Code to obtain legal redress or the replacement of the good and if impossible, the resolution or reduction of the price.

Article 11.1 Legal guarantee of conformity

Article L217-4 of the Consumer Code
“The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.
He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility.

Article L217-5 of the Consumer Code
“To comply with the contract, the property must:
1° Be suitable for the use usually expected of similar goods and, where applicable:
- correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- present the qualities that a buyer can legitimately expect having regard to the public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling;
2° Or present the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

Article L 217-9 of the Consumer Code : “In the event of a lack of conformity, the buyer chooses between repair and replacement of the goods”.

However, the seller may not proceed according to the buyer's choice if this choice results in a cost that is manifestly disproportionate with regard to the other method, taking into account the value of the goods or the importance of the defect. He is then required to proceed, unless impossible, according to the method not chosen by the buyer. Article L217-11 of the Consumer Code: “The application of the provisions of Articles L. 217-9 and L. 217-10 takes place at no cost to the buyer”. Article L217-12 of the Consumer Code: “The action resulting from the lack of conformity is prescribed two years from the delivery of the good”.

Article 11.2 Legal guarantee against hidden defects

Article 1641 of the civil code
“The seller is bound by the guarantee for hidden defects in the thing sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the buyer would not have acquired it, or would not would have given a lower price for them, if he had known about them.

Article 1643 Civil Code
He is liable for hidden defects, even if he is not aware of them, unless, in this case, he has stipulated that he will not be obliged to provide any guarantee.
Article 1644 Civil Code
In the case of articles 1641 and 1643, the buyer has the choice of returning the thing and having the price refunded, or keeping the thing and having part of the price refunded. Article 1648 paragraph 1 of the civil code

“The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.”

Responsibilities

The seller, in the online sales process, is only bound by an obligation of means; it cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.

Intellectual property

All elements of the Petit Pan site are and remain the intellectual and exclusive property of Petit Pan.

No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound.

In accordance with the law relating to data processing, files and freedoms of January 6, 1978, personal information relating to buyers may be subject to automated processing.

Petit Pan reserves the right to collect information about buyers, including by using cookies, and, if it wishes, to transmit the information collected to commercial partners.

Buyers may object to the disclosure of their contact details by notifying Petit Pan. Likewise, users have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978.

Petit Pan will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

Petit Pan's computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Petit Pan will not be responsible for the total or partial non-performance of its obligations under this contract, if this non-performance is caused by an event constituting force majeure, in particular in the event of a disruption or total or partial strike, particularly of the services. postal and means of transport and/or communication, flood or fire.

Petit Pan will notify the customer of an event constituting force majeure, within 5 working days following its occurrence.

In the event of a dispute, jurisdiction is assigned to the competent courts of Paris, notwithstanding multiple defendants or warranty claims.
